VETERAN trainer Ken Rattray has had a minor victory in his appeal against disqualification.
Last March Tasracing stewards charged Rattray pursuant to AHRR 190(1),(2) and (4) for failing to present Destreos free of the prohibited substance Cobalt.
Stewards concluded their case in June, which resulted in Rattray being disqualified for five years, with the sentence to expire on June 6, 2023.
In determining the penalty stewards took into consideration Rattray’s reserved plea, his licence history, including that he had five prior disqualifications for prohibited substance matters, his personal subjective circumstances and the need that any penalty reflect the serious nature of prohibited substance offences and provide both a specific and general deterrent.
Originally appealing against the conviction and penalty, Rattray withdrew his appeal against the disqualification, but sought a reduction in sentence.
After hearing evidence from both parties the tribunal reduced Rattray’s term to three years.
